This Acceptable Use Policy (“AUP”) forms part of the Terms of Service and applies to everyone who uses evo uptime. Its purpose is to protect the Service, its users, and the third-party systems that our infrastructure connects to.

1. Scope

evo uptime makes automated requests from our infrastructure to internet endpoints that you configure. You are responsible for every endpoint, URL, status page and notification you set up, and for ensuring your use complies with this AUP and applicable law.

2. Authorisation to monitor

You may configure monitoring only for endpoints that:

  • you own or operate; or
  • you have explicit permission from the operator to monitor.

You must stop monitoring an endpoint immediately if that permission ends or if the operator asks you to stop.

3. Prohibited uses

You must not use the Service to:

  • carry out or assist any denial-of-service or distributed denial-of-service activity, flooding, or deliberately abusive request volume, or any load, stress or performance testing intended to degrade or overwhelm a target — including by setting excessive check frequencies or creating many monitors against the same target;
  • port-scan, vulnerability-scan, penetration-test, enumerate, fingerprint or otherwise probe systems you do not own or are not authorised to test;
  • monitor endpoints on private or internal networks, loopback addresses, link-local addresses, or cloud-provider metadata endpoints, or otherwise attempt to reach non-public infrastructure through the Service;
  • circumvent or attempt to circumvent plan limits, quotas, the minimum check interval, rate limits, or our server-side request forgery and network protections, including by operating multiple accounts;
  • publish, transmit or link to content that is unlawful, infringing, defamatory, deceptive, malicious (including malware or phishing), or that impersonates another person or organisation;
  • send spam or unsolicited commercial communications through notification channels, or send notifications to recipients who have not agreed to receive them;
  • infringe intellectual-property or privacy rights, or breach export-control or sanctions laws;
  • reverse engineer, resell, sub-license or provide the Service to third parties except as expressly permitted; or
  • scrape the Service, interfere with its operation, or probe, scan or test the vulnerability of the Service or its network without our prior written consent.

4. Status pages and notifications

  • Public status pages must not contain unlawful, infringing, misleading or abusive content, and must not impersonate a brand or organisation you are not authorised to represent.
  • You are responsible for the content of incident notes and status-page text, which may be publicly visible.
  • Notification channels must be used only to alert people who expect and have consented to receive operational alerts from you.

5. Our technical safeguards

To keep monitoring well-behaved, the Service enforces a minimum interval between checks, per-plan caps on the number of monitors, and body-less requests wherever possible (an HEAD request first, falling back to a single GET only when required). Requests are sent with an identifiable user-agent, follow at most a few redirects, use short connection and overall timeouts, and are blocked from reaching private or reserved network ranges at every step. A circuit breaker pauses checks if our own infrastructure loses outbound connectivity. These measures do not relieve you of your obligations under this AUP.

6. Reporting abuse

If you believe the Service is being used to target your systems without authorisation, or in any other way that breaches this AUP, email office@softivo.ro with the affected hostname or IP address, the approximate time and pattern of the requests, and any relevant logs. We investigate reports and take appropriate action.

7. Enforcement

Depending on the severity of a breach, we may warn you, throttle or disable specific monitors or channels, suspend or terminate your account, remove content, and cooperate with law enforcement. We may act without prior notice where necessary to prevent harm, protect third parties, or comply with law. No refund is due for an account terminated for breach of this AUP or the Terms.

8. Changes

We may update this AUP. Material changes are notified as described in the Terms of Service. Questions: office@softivo.ro.
